Terms of Service

1. Service Description

MailCheck provides an email verification API that checks email addresses for validity through syntax validation, disposable email detection, DNS/MX record lookups, and SMTP verification. The service is available at mailcheck.dev and via our REST API.

2. Account Responsibilities

By creating an account, you agree to:

  • Provide accurate registration information
  • Keep your password and API keys secure and confidential
  • Be responsible for all activity under your account
  • Notify us immediately of any unauthorized use

You must be at least 18 years old or have the legal capacity to enter into these terms.

3. Acceptable Use

You agree not to use MailCheck to:

  • Send spam or unsolicited communications
  • Harvest or collect email addresses for unauthorized purposes
  • Attempt to circumvent rate limits or usage quotas
  • Interfere with or disrupt the service or its infrastructure
  • Use the service for any illegal or fraudulent activity
  • Reverse-engineer, decompile, or attempt to extract source code
  • Resell or redistribute the service without written permission

We reserve the right to suspend or terminate accounts that violate these terms.

4. Rate Limits & Quotas

Each plan has a monthly verification limit. Usage resets at the beginning of each calendar month.

  • API Rate Limit: 60 requests per minute for authenticated endpoints
  • Signup Rate Limit: 3 requests per hour per IP address
  • Bulk Verification: Up to 100 emails per request

Cached verification results (within 24 hours) do not count against your monthly quota. Exceeding your quota will result in 429 responses until the next billing cycle or plan upgrade.

5. Payment Terms

Paid plans are billed monthly via Stripe. By subscribing, you authorize recurring charges to your payment method.

  • Prices are listed in Euros (€) and exclude applicable taxes
  • Subscriptions renew automatically unless cancelled
  • You may cancel at any time; access continues until the end of the billing period
  • No refunds are provided for partial months of service
  • Failed payments may result in temporary service restrictions

We reserve the right to change pricing with 30 days' notice. Existing subscriptions will be honored at their current rate until renewal.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for downtime due to maintenance, third-party service failures, or events beyond our reasonable control.

7. Limitation of Liability

To the maximum extent permitted by law:

  • MailCheck is provided "as is" without warranties of any kind
  • We do not guarantee the accuracy of verification results
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the 12 months preceding the claim

Email verification involves heuristics and third-party mail server behavior. Results should be used as one factor in your decision-making, not as the sole determinant.

8. Termination

Either party may terminate this agreement at any time:

  • You may close your account and cancel subscriptions via the dashboard or by contacting support
  • We may suspend or terminate accounts that violate these terms, with or without notice

Upon termination, your API keys are revoked and your data is handled according to our Privacy Policy.

9. Governing Law

These terms are governed by the laws of the European Union and the laws of Belgium, where MailCheck is established. Any disputes shall be resolved in the courts of Belgium.
